The 2018 Farm Bill legalized hemp and all of its derivatives at the federal level, except when they are found in products containing more than 0.3% delta-9 THC. Although HHC doesn’t contain THC, it is still illegal because it was lab-produced from CBD under pressure with the help of a catalyst.

This could mean that both synthetic and natural compounds were involved in the creation of HHC, which could lead to the Drug Enforcement Administration (DEA imposing a ban on this substance. Although HHC is similar to delta 8 THC in some states, it has not been detected.

This cannabinoid, if found illegal, will be treated at the same level federally as delta 9 THC. Users who use it will be subject to the same penalties as those using delta 9.
